8:30 o'clock a.m. Present were Chairman Fred M. Devish, Vice-Chairman Kelly B. Dennis, Member Bob Latham and County Clerk Melissa Jones.

The Pledge of Allegiance was recited to the Flag.

Bob moved to approve & ratify the minutes from August 5 & 6, 2024. Kelly seconded, all ayes, motion carried.

Kelly moved to accept "Disclosure Statement for Investment of Public Funds" from the following people: Fred M. Devish, Kelly B. Dennis, Bob Latham, Brenda L. Wagner, Melissa Jones, Aimee Holt, Meghan Porter, Michelle Hegge, Tamara L. Jundt, Teresa Lang, Krystyna Wood, Janelle Peterson, Alana Greiner, Jeff Hodge, Alex Jessen, April Gill, Peggy Boardman, Julie Crawford, Amy Porter, Charles Harrison, Thomas Lubas, Timothy R. Lyons, Randy Leinen and Alycia Davis. Bob seconded, all ayes, motion carried.

Bob moved to approve and for the chairman to sign a Statement of Value on County Buildings. Kelly seconded, all ayes, motion carried.

After discussion, Kelly moved to approve the following resolution:

RESOLUTION N0. 2024-25

RESOLUTION DECLARING THE BEULAH

IMPROVEMENT AND SERVICE DISTRICT ORGANIZED

WHEREAS, a petition to organize the "Beulah Improvement and Service District" was filed with the County Clerk, Crook County, Wyoming on October 2, 2023 and the Board of County Commissioners of Crook County, Wyoming on December 5, 2023 in accordance with W.S. 18-12-101 et seq., the Improvement and Service District Act; and

WHEREAS, that petition was set down for hearing before the Board of County Commissioners of Crook County, Wyoming on February 7, 2024; and

WHEREAS, notice of such hearing was duly published in The Sundance Times, Moorcroft Leader and Wyoming Pioneer on December 21, 2023 and January 19, 2024, on the County website and was mailed via first class mail to all landowners; and

WHEREAS, said hearing was duly conducted and a thirty (30) day protest period allowed as required by law and it was thereupon ordered that an election be conducted; and

WHEREAS, the County Clerk published proclamation of the election in The Sundance Times at Sundance, Crook County, Wyoming on April 25, 2024; and

WHEREAS, the County Clerk conducted a mail ballot election on August 20, 2024 to establish the district and select two (2) Directors for a four (4) year term, and three (3) Directors for a two (2) year term; and

WHEREAS, the election was canvassed by the appointed canvassing board on August 20, 2024 and that the foresaid formation election for the Beulah Improvement and Service District carried by twenty-five (25) votes for the formation and zero (0) votes against the formation; and

WHEREAS, the following candidates received the highest number of votes to become directors of the newly formed district: Pat Bundy & Jean Quade for a four (4) year term and Eric Sutton, Dylan Tramp & Bob Waddell for a two (2) year term; and

WHEREAS, costs associated with the formation of the district, whether the formation passes or not, it to be paid by the sponsors of the proposed district; and

WHEREAS, the map of the Beulah Improvement and Service District filed in the Crook County Clerk's Office in Sundance, Wyoming at Instrument No. __________in File No. ______Map No. ______ and the legal description is as follows:

Lots 1-32 Beulah Land Estates Subdivision, 6th P.M., Crook County, WY

Lots 1 & 3-5 Redwater Estates Subdivision, 6th P.M., Crook County, WY

Township 53 North, Range 60 West, 6th P.M., Crook County, WY

Sec 30 – a tract located in the SW1/4SW1/4 containing 5.72 acres

Sec 30 – a tract located in the SW1/4 containing 11.20 acres

NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners in and for Crook County, Wyoming, that:

1. A special district has been organized and declare the corporate name to be BEULAH Improvement and Service DISTRICT in accordance with the Improvement and Service District Act.

2. The purpose of the district is for those purposes set forth in W.S. 18-12-101 et seq,.

3. The first board of directors for a 4 (four) year term are Pat Bundy and Jean Quade and for a two (2) year term are Eric Sutton, Dylan Tramp and Bob Waddell. Each elected Director must complete an Application for Special District Director to accept nomination and a failure to do so in a timely manner shall result in a vacancy in said office.

4. This Resolution shall be recorded in the County Clerk's office, indexed on all land within the district, noted on the recorded map of the district and sent to the Department of Revenue along with the Map of the District.

5. Any remaining deposit after all expenses for formation of the district have been paid from said funds shall be returned to the Petitioners after all expenses of the County have been paid.

RESOLUTION DECLARING THE YELLOWSTONE L&R RANCH

IMPROVEMENT AND SERVICE DISTRICT ORGANIZED

WHEREAS, a petition to organize the "Yellowstone L&R Ranch Improvement and Service District" was filed with the County Clerk, Crook County, Wyoming on September 1, 2023 and the Board of County Commissioners of Crook County, Wyoming on November 7, 2023 in accordance with W.S. 18-12-101 et seq., the Improvement and Service District Act; and

WHEREAS, that petition was set down for hearing before the Board of County Commissioners of Crook County, Wyoming on January 3, 2024; and

WHEREAS, notice of such hearing was duly published in The Sundance Times, Moorcroft Leader and Wyoming Pioneer on November 16 and December 14, 2023, on the County website and was mailed via first class mail to all landowners; and

WHEREAS, said hearing was duly conducted and a thirty (30) day protest period allowed as required by law, no written or oral objections were made, and it was thereupon ordered that an election be conducted; and

WHEREAS, the County Clerk published proclamation of the election in The Sundance Times at Sundance, Crook County, Wyoming on April 25, 2024; and

WHEREAS, the County Clerk conducted a mail ballot election on August 20, 2024, to establish the district and select one (1) Director for a four (4) year term, and two (2) Directors for a two (2) year term; and

WHEREAS, the election was canvassed by the appointed canvassing board on August 20, 2024, and that the foresaid formation election for the Yellowstone L&R Ranch Improvement and Service District carried by four (4) votes for the formation and two (2) votes against the formation; and

WHEREAS, the following candidate received the highest number of votes to become directors of the newly formed district: Brenda Mattison the 2 year term and whose term will expire in 2026; and

WHEREAS, the following candidates received the highest number of write-in votes to become directors of the newly formed district: Les Lindskov the 2 year term and whose term will expire in 2026 and James W. Roquemore the 4 year term and whose term will expire in 2028; and

WHEREAS said district will continue to have elections for directors for 4 year terms of office every two years on the Tuesday following the 1st Monday in May and shall conduct the election in accordance with W.S. 22-29-113 through 22-29-116 the Special District Election Code; and

WHEREAS, costs associated with the formation of the district, whether the formation passes or not, was paid by the sponsors of the proposed district; and

NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners in and for Crook County, Wyoming, that:

1. A special district has been organized by the electors of the district in accordance with the Improvement and Service District Act and the Board hereby declares the corporate name to be YELLOWSTONE L&R RANCH Improvement and Service DISTRICT.

2. The purpose of the district and the description of the improvements and services to be provided by the district are to repair and maintain the common roads within the proposed district; however, the proposed district will not maintain any private easements or right of way located within the district boundaries. The proposed district may also provide subdivision governance for the homeowners within the district and may provide any other legal purpose authorized by law.

3. The first elected director of the board of directors for a 2 (two) year term is Brenda Mattison.

4. The remaining elected directors of the board of directors nominated by write-in votes are: Les Lindskov for a 2 year term and James W. Roquemore for a 4 year term. Each elected Director must complete an Application for Special District Director to accept nomination and a failure to do so in a timely manner shall result in a vacancy in said office.

5. This Resolution shall be recorded in the County Clerk's office, indexed on all land within the district, noted on the recorded map of the district and sent to the Department of Revenue along with the Map of the District.

Dan Thomas, County Assessor, Joseph Baron, County Attorney, Julie Crawford, Clerk of District Court, Jeff Hodge, County Sheriff and Tammy Jundt, County Treasurer were present to go over items of interest within their departments.

Dan Thomas, County Assessor: Last month in the Assessor's Office there were 42 Deeds of ownership transfer processed. The field crew is finished with the annual sweep reviews and will begin new construction reviews this month. I attended the department head and IT committee meetings. Tax roll was initially sent over last month. Appeal hearings were completed at the CBOE.

Joseph M. Baron, County Attorney: Criminal Cases in the past month: New Cases: 44 Closed Cases: 43 Current Case Load: 76 In Court: 66 times Juvenile/Diversion Cases: 28 Work on Criminal cases. Staff and I are on call evenings and weekends. Attended meetings. Assisted county officers and departments with legal questions. Continued working on county road matters.

Melissa Jones, County Clerk: recorded 455 documents & created 390 titles, worked with auditor while he was here and provided information he requested, will be back the end of September / beginning of October, worked on finishing fixed assets, attended the department head meeting, compensation committee meeting, IT meeting, 2 Teams meetings with Clerks, prepared paperwork for BOE meetings, worked on 2 Improvement & Service District Enlargements, working on processing 3 public records requests, held 2 special district elections, held 3 election judge trainings, held the Primary Election, primary had a 48% turn out, filing period for general candidates has ended, had to have all information in the portal by Wednesday August 28th, state addressed the questions brought up last month by Mr. Keop stating that the Systor has been addressed and is acceptable for use during elections.

Julie Crawford, Clerk of the District Court: Receipts for July – submitted after Commissioners' Meeting: $11,656.89 with $2,403.75 to the County Total Receipts for August: $11,811.18 with $2,781.00 to the County 17 new case filings 25 record searches 9 new passports, assisted multiple other customers with renewal passports 1 civil appeal in process The Wyoming Judicial Branch received a grant from the State Justice Institute to accomplish court security assessments in eleven courthouses across the state. This will provide critical information to members of the Joint Appropriations Committee of the Wyoming Legislature.  Based on the assessments, the Legislature can authorize monies for matching grants to partner with the counties who could not otherwise afford the court security improvements.  Crook County has been selected for a security assessment that will be conducted on October 1st. I prepared the security assessment form that will be sent out this week. I sent out 75 jury notices for an upcoming trial in September. My deputy is out of the office for an undetermined amount of time, so I am running the office by myself in the interim. Every effort will be made to keep the office open with the help of other offices as needed and possibly some part-time help. I attended the robing ceremony for Judge Michael McGrady on August 2nd, one IT Meeting, three Teams meetings with the District Court Clerks, a Teams training for the electronic submission of appeals to the Supreme Court, the department heads meeting and the employee compensation committee meeting.

Jeff Hodge, County Sheriff: held a Public Safety night in conjunction with the monthly movie that the chamber puts on - all went well lots of people in attendance, been dealing with E911 fee increases, Senator Case wants to work on regional dispatch centers, we lost a deputy going back to the Highway Patrol, our contract with Game & Fish is up for the year, starting up on the contract with the Livestock Board, attended the Compensation Committee meeting, have been invited to attend/testify at the Ag Committee meeting scheduled on September 11th in Buffalo to testify on the state leases in the Moskee area.

Tammy Jundt, County Treasurer: Total receipts were $2,050,685.21 and disbursements to the county boards, towns and schools were $778,700.08. In August we did a total of 1,680 transactions. We advertised in the county newspaper, the 2023 delinquent property taxes for tax sale which was August 21st. We started out advertising 25 parcels. We ended up taking 2 parcels to tax sale. Worked on the mill levy distribution and entered it into Taxwise for 2024. Worked with Leonard with Leo Riley & Co while he was here auditing our office. He'll be back in October to finish. Submitted two reports to the Department of Revenue – first the motor vehicle valuation report and the 2024 motor vehicle veteran's exemption report. Also completed the Treasurer's part on the county road construction and maintenance fund annual report. I emailed the Predatory Animal receipts and disbursements report to the commissioners. I have started on the 2024 tax roll over, should be completed this week or next. I am going to have Master Touch print and send out our property tax invoices this year. Today I am withdrawing the CD at Sundance State Bank that has matured. It should have accrued a little over $80,000 in interest. We did one redemption on a parcel. I attended the employee compensation and dept head meeting; and sat in on the property tax protest hearing.

County Commissioners: Kelly: Attended board meetings of various boards around the county, BOE meeting, had conversations with constituents and Morgan on county roads. Bob: Attended IT Committee meetings, Fair Board meetings, PreCorp annual meeting, BOE meeting, was present to accept a donation of a Type 6 Wildland Firefighting Engine from BLM, helped Charlie move fire trucks, took calls on roads, traveled Kara Mountain Rd & Banks Rd with Morgan Fred: attended BOE meeting, Compensation Committee meeting and Fire Board meetings, was present to accept a donation of a Type 6 Wildland Firefighting Engine from BLM, fielded calls on roads & spoke with Morgan about them, conversations with Larry, attended various zoom meetings; Old Growth, Black Hills National Forest plan and WCCA

Present for the final hearing on the Douglas No. 1 Minor Subdivision were Caleb Peters, Tim Lyons, John D. Davis, Callie Hilty, Cassie Snook and Joe Baron. After discussion, Kelly moved to approve the Order Approving Minor Subdivision and Minor Subdivision Plat. Bob seconded, all ayes, motion carried.

Present for the annual State Transportation Improvement Plan presentation were Scott Taylor, District Engineer, Isaac Finkle, District Construction Engineer, Michelle Edwards, District Traffic Engineer, Laura Dalles, Public Relations Specialist, Steven Dietrich, Resident Engineer, Brad Marchant, Area Maintenance Supervisor and Josh Diede, Moorcroft Shop Supervisor, WYDOT also present were John D. Steve Dietrich, Resident Engineer, Wyoming Department of Transportation (WYDOT), gave an update on bridge and road projects.

Bob moved to approve & ratify the BOE minutes from August 28, 2024. Kelly seconded, all ayes, motion carried.

Present for opening of the propane bids were Phil Schutt, John D. Davis, Larry Schommer and Morgan Ellsbury. Five (5) bids were received, after discussion, Kelly moved to approve the proposal from Blakeman Propane. Bob seconded, all ayes, motion carried.

Morgan Ellsbury, Road and Bridge Superintendent and Larry Schommer, Facilities Maintenance Supervisor, continued their monthly reports.

Bob moved to approve for Morgan to over draw two salary expenditure lines as two other salary expenditure lines will not be spent completely and will cover the overage. Kelly seconded, all ayes, motion carried.

The district has presented that the requirements listed in W.S. 22-29-301(a)(i) have been met thus an election need not be held on enlargement.
