PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS AT THE COURTHOUSE IN SUNDANCE, CROOK COUNTY, WYOMING

8:30 o’clock a.m. Present were Chairman Fred M. Devish, Vice-Chairman, Kelly B. Dennis (via conference call), Member Bob Latham and County Clerk Melissa Jones.

Bob moved to approve the following resolution and the ARPA Grants Certification Statement:

LOCAL GOVERNMENT PROJECT ARPA GRANTS

RESOLUTION NO. 2023-5

Entitled: A RESOLUTION AUTHORIZING SUBMISSION OF A LOCAL GOVERNMENT PROJECT ARPA GRANTS APPLICATION TO THE STATE LOAN AND INVESTMENT BOARD ON BEHALF ON THE GOVERNING BODY FOR CROOK COUNTY, WYOMING.

FOR THE PURPOSE OF: building a Crook County Consolidated Public Response Facility

WITNESSETH

WHEREAS, the governing body of Crook County, Wyoming desires to participate in the LOCAL GOVERNMENT PROJECT ARPA GRANT program to assist in financing the request; and

WHEREAS, the governing body of Crook County, Wyoming recognizes the need for the request; and

WHEREAS, the Local Government Project ARPA Grant program requires that certain criteria be met, as described in the State Loan and Investment Board’s Rules and Regulations governing the program, and to the best of our knowledge this application meets those criteria; and

WHEREAS, if any of the disbursed grant funds are later deemed to not comply with the SLIB criteria or the criteria of the American Rescue Plan Act (ARPA), the grant applicant agrees to repay the ineligible grant funds within 15 days of such finding to the Office of State Lands and Investments.

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF CROOK COUNTY, WYOMING that a grant application in the amount of $2,153,700.00 be submitted to the State Loan and Investment Board for consideration at the next Board meeting after application processing to assist in funding the Crook County Consolidated Public Response Facility.

BE IT FURTHER RESOLVED that Fred M. Devish, Chairman, Crook County Commissioners and Virginia Burke, Secretary, Road & Bridge, Fire and Facilities are hereby designated as the authorized representatives of Crook County, Wyoming to act on behalf of the Governing Body on all matters relating to this grant application.

Fred vacated the chair and seconded, Bob voted aye, Kelly voted nay, Fred vacated the chair and voted aye motion carried.

Kelly submitted the following statement: I opposed this because it is a huge growth of government. It builds a monument to a few condescending people. It sets an expensive structure on land that should have never been purchased.

Kelly moved to accept the resignation of Johnie Ridinger as the Area 3 board member on the Crook County

Weed & Pest District. Bob seconded, all ayes, motion carried.

After discussion, Bob moved to approve the following resolution:

RESOLUTION NO. 2023-6

RESOLUTION CONCERNING APPOINTING SPECIAL PROSECUTORS

WHEREAS the Crook County and Prosecuting Attorney has in the past entered into agreements with the Campbell County Attorney’s Office and the Weston County Attorney’s Office to review, prosecute and otherwise proceed to make, in their sole discretion, a proper disposition of all potential matters in which the Crook County Attorney’s Office has a conflict of interest;

WHEREAS various County and Prosecuting Attorney’s Offices and District Attorney Offices will provide their services free of charge to Crook County in exchange for the Crook County and Prosecuting Attorney’s Office acting in their county free of charge when conflicts of interest arise in their respective counties;

WHEREAS Crook County will reimburse other counties for all costs and expenses of review and prosecution; and

WHEREAS Wyoming Statute §18-3-302 authorizes said action and it benefits Crook County;

THEREFORE, be it resolved that the Crook County and Prosecuting Attorney is authorized to appoint any County Attorney or District Attorney and their respective deputies to act as special prosecutors in Crook County, Wyoming when appointed to do so by the Crook County and Prosecuting Attorney to act as such in any particular case.

Motion made, seconded and carried in an open meeting on January 17, 2023.

All interested parties are encouraged to apply. Applications can be obtained from the Crook County Clerk’s Office, P.O. Box 37, Sundance, WY 82729, 307-283-1323. All applications must be submitted to the County Clerk by or before March 3, 2023, at 5:00 o’clock p.m.

The meeting adjourned at 9:15 o’clock a.m. to meet in regular session on February 7 & 8, 2023 at 8:30 o’clock a.m., in the Commissioner’s Room at the Courthouse in Sundance, Wyoming.
