Mike Gosse, District Ranger, USFS, Jeremy Dedic, Forester, Chris Zoller, Fire Management Officer, Brian Rafordy, Plans for Fish Fire and Trevor Papenfuss, Assistant Fire Manager, Wyoming State Forestry and Doug Leis, County Fire Warden were present to give an update on the Fish Fire, also present were Tracey Jundt, Theresa Curren and Larry Schommer

Theresa Curren, County Assessor explained the mill levy to the Board. Jeanne moved to order the following mill levy on all Crook County property as authorized by law as presented by Theresa Curren, County Assessor:

Kendra Meidinger, Crook County Promotion Board, via email, presented a request to put the 2% Lodging Tax on the 2022 General Election Ballot. Fred moved to put the following on the 2022 General Election Ballot: “Shall Crook County be authorized to renew a lodging tax at a rate of two percent (2%) upon the sales price paid for sleeping accommodations for quests in hotels, motels, tourist courts, trailer parks, campgrounds, dude ranches, short-term condominiums, and similar establishments, in accordance with Wyoming Statute 39-15-204(a)(ii)” Jeanne seconded, all ayes, motion carried.

Jeanne approved a letter written to Sundance State Bank for credit card authorization changes. Fred seconded, all ayes, motion carried.

Jeanne moved for the chairman to sign Attachment B to the Grant Agreement Between Wyoming Department of Health, Public Health Division and Crook County. Fred seconded, all ayes, motion carried.

Tina Wood, Clerk of District Court, via Teams, Jeff Hodge, County Sheriff, Tammy Jundt, County Treasurer and Theresa Curren, County Assessor were present to go over items of interest within their departments.

Theresa Curren, County Assessor: Entire office attended Wyoming Assessor Association meetings via Zoom meeting for two days in July.  A large portion of the meetings discussed Tax Relief.  Went through a Realware upgrade for our CAMA system and were down for a couple of days.  Worked with Special Districts for the collection of assessments for I & S Districts and entities that can levy a mill. 

Melissa Jones, County Clerk: Office made 319 titles and recorded 706 documents. Worked on finalizing the budget figures, Meghan and I attended a WYDOT Training, mailed out liquor license renewals, tracking last of the paperwork due from special districts, working on election publishing, got election machine testing done, been issuing absentees have issued around 260 absentees and have about 50% returned. Have been working on getting fiscal year information requested by auditor sent to them, served breakfast at the fair.

Jeff Hodge, County Sheriff: Presented jail roster, received no push back on presenting home owners with information on voluntary evacuations due to Fish Fire, working on getting the new 911 system up & running, preparing for new phone system, down 3 deputies: 1 retired, 1 moved back to jail, 1 on administrative leave after weekend incident, have 2 patrol vehicles that are damaged needing body repairs.

Joseph M. Baron, County Attorney: Joe: New cases 31, closed cases 78, current case load 114, in court 47 times John: new cases 41, closed cases 9, current case load 44, in court 19 times. Joe pretty much spent most of the time in court or preparing for court. Hired a Deputy County Attorney John Starcevich, effective July 11, 2022. Continue to hold court in person and by less and less by Video Conference with TEAMS. Dealt with a few civil matters for the county officials.

Tammy Jundt, County Treasurer: Total receipts were $2,474,380.79 and disbursements to the county, county boards, towns and schools were $947,484.67. In July we did 1,570 transactions. This month we have been calling the property taxpayers who are delinquent on their taxes. I completed and submitted the WDE160 report to WY Department of Education. Teresa and I attended Lynda Bush’s ceremony administering her oath of office. I worked with Mel on finalizing the budget. Had the sheriff’s department seize plates for a NSF check. Teresa and I attended WYDOT training on vehicle dealer and county training. Shred truck was in town, so we did more cleaning and shredded more old documents. I rolled over the funds and estimated revenue to the new fiscal year. We completed and submitted the 12-mill report to the State Auditor’s office. I participated last Friday in the cooking and serving breakfast at the fair.

Tina Wood, Clerk of the District Court: I attended two child support meetings; attended the robing ceremony for Judge Lynda Bush; It was great to have the Wyoming Supreme Court Justices and the Governor here for Judge Bush’s special day; Julie and I both took some vacation time; we had our initial meeting with the Supreme Court in preparation for our new computer program; helped with the Pancake Breakfast at the Crook County Fair;

County Commissioners: Kelly: Took calls on Road & Bridge and mag. Water attended several various meetings Jeanne: met with Mandy Marley about the basement remodel, met with Dru Bower about Forest Service Assessment comments, attended budget hearing, WY State meeting on Forest Plan, SD State meeting on Forest Plan, NE WY Outdoor Rec. Collaboration meeting and served at the fair breakfast. Fred: Attended Commissioner meeting via conference call served at the fair breakfast working at the Fish Fire.

Dru Palmer, Dru Consulting was present via Teams to discuss the BHNF Assessment comments to be uploaded today also present were Senator Driskill, Tim Lyons, Sarah Pridgeon and Joe Baron.

Jeanne moved for the chairman to sign a comment letter on the BHNF Assessment. Fred seconded, all ayes, motion carried.

Larry Schommer, Facilities Maintenance Supervisor, gave a monthly report.

Jeanne moved for the chairman to sign a Contract with Independent Contractor for County Website Maintenance. Fred seconded, all ayes, motion carried.

Present for the monthly KLH update were Tom Overstreet & Tina Wood, via Teams, Tammy Jundt, Theresa Curren, Jeff Hodge, Joe Baron and Tim Lyons.

Jeanne moved for bonds for all county board members required by law to be set by the Board of County Commissioners to be a minimum of $10,000.00 unless local boards deem a higher bond is appropriate. Kelly vacated the chair and seconded the motion. Jeanne voted aye, Kelly vacated the chair and voted aye, motion carried.

Preston Beckstead, Resident Engineer, Wyoming Department of Transportation (WYDOT), gave an update on bridge and road projects.

Jeanne moved to approve the following resolution:

RESOLUTION 2022-20

RESOLUTION AUTHORIZING THE ROAD AND BRIDGE DEPARTMENT TO SUBMIT AN APPLICATION FOR A CMAQ GRANT

WHEREAS, Crook County has identified a need for additional funding for dust mitigation for the safety and health of the residents of Crook County; and

WHEREAS, Congestion Mitigation/Air Quality (CMAQ) Grant Funds are available through the Wyoming Department of Transportation in Fiscal Year 2022 to address the dust problems on County Roads; and

WHEREAS, Crook County will, if approved for funding, be able to suppress dust on approximately forty-one (41) non-consecutive miles of county roads, listed in the following order of priority:

County Road #49, Banks Road – 3.75 miles; County Road #247, Clark Road – 1.45 miles; County Road #129, Sand Creek Road – 1.2 miles; County Road #195, Homestake Road – 0.25 mile; County Road #103, Shipwheel Road – 2.75 miles; County Road #116, Cabin Creek Road – 3.1 miles; County Road #68, D Road - 18 miles; County Road #266, Miller Creek Road – 2.5 miles; County Road #12, Bertha Road – 3.5 miles; County Road #249, Government Valley Road – 4.5 miles:

WHEREAS the application for the CMAQ grant request must be submitted by August 15, 2022; and

WHEREAS, the Board of County Commissioners have determined this use of CMAQ funding for dust mitigation will benefit the safety and health of the residents of Crook County;

THEREFORE, BE IT RESOLVED by the Board of County Commissioners in and for Crook County that Crook County shall file an application requesting $242,457.60 with the Wyoming Department of Transportation for a CMAQ Grant for applying magnesium chloride to certain County Roads within Crook County;

WHEREAS, Crook County acknowledges that if funded, the CMAQ project shall be completed prior to December 31, 2025;

WHEREAS, the governing body for Crook County agrees to set aside a minimum of $60,614.00 as a line item in its budget for the required twenty percent (20%) local cash match on the project;

IT IS FURTHER RESOLVED that Morgan Ellsbury, Road & Bridge Superintendent is authorized to execute, and the Clerk to attest to, any agreement or application on behalf of Crook County.

Morgan Ellsbury, Road and Bridge Superintendent gave a monthly report.

Mike Gosse, District Ranger, USFS, Jeremy Dedic, Forester, Kim Hemenway, PIO Fish Fire, Wyoming State Forestry, Jim Hutchinson, Acting Field Manager, BLM and Doug Leis, County Fire Warden were present to give an update on the Fish Fire, also present were Morgan Ellsubry, Larry Schommer and Tracey Jundt.

Present for opening of the property insurance bids was Ray Gallegos, Account Executive, HUB international, via Teams. The only bid received was from HUB International Insurance. After discussion, Jeanne moved to approve the proposal from HUB International for $72,386.00. Fred seconded, all ayes, motion carried.

Present for the public hearing to determine whether to proceed with a special district election to establish the Warbonnet Canyon Estates Improvement and Service District were Larry & Nancy Brown, Jim Bowman, Dave Goold, Tammy Jundt, Theresa Curren and Pat Carpenter. No oral or written objections were received.

Fred moved to approve the following resolution:

RESOLUTION No. 2022-21

TO ACCEPT PETITION FOR THE PROPOSED WARBONNET CANYON ESTATES IMPROVEMENT AND SERVICE DISTRICT

WHEREAS, a petition to organize the “Warbonnet Canyon Estates Improvement and Service District” was filed with the County Clerk, Crook County, Wyoming on March 29, 2022 and the Board of County Commissioners of Crook County, Wyoming on June 8, 2022; and

WHEREAS, that petition was set down for hearing before the Board of County Commissioners of Crook County, Wyoming on August 2, 2022; and

WHEREAS, notice of such hearing was published in The Sundance Times at Sundance, Crook County, Wyoming on July 14 and 21, 2022; and

WHEREAS, said hearing was duly conducted and a thirty (30) day protest period allowed as required by law and it was thereupon ordered that an election be conducted; and

WHEREAS, costs associated with the formation of the district, whether the formation passes or not, shall be the responsibility of and paid by the sponsors of the proposed district.

WHEREAS, no objections were received for exclusion from the proposed district or for the inclusion of additional lands in the proposed district.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSION IN AND FOR CROOK COUNTY, WYOMING THAT:

The formation of the Warbonnet Canyon Estates Improvement and Service District as described in the petition and notice shall be set for an election conducted by the County Clerk;

The County Clerk shall conduct an election to establish the district and an election to elect the initial Directors by selecting one (1) Director for one four (4) year term, two (2) Directors for two (2) year terms, until their successors are elected and qualified at the regular scheduled subsequent director election as provided in W.S. 22-29-112;

The County Clerk is hereby directed to publish notice of the election in The Sundance Times at Sundance, Crook County, Wyoming as soon as legally possible;

The County Clerk shall hold the election by mail ballot.

ADOPTED this 2nd day of August, 2022.

Alycia Conroy-Davis, Supervisor, Crook County Weed & Pest and Alex Orozco-Lopez, UW Extension Educator, gave monthly reports. Also present were Mandy Marley & Joe Baron.

Jeanne moved to go into executive session per W.S. 16-4-405(a)(ii). Discussion was held, Kelly disagreed with the application of that provision of the statute applying to the executive session. Fred seconded, Jeanne voted aye, Fred voted aye, Kelly vacated the chair and voted nay, motion carried.

Back into regular session at 1:52 p.m.

Present for the final hearing of the Jacobson #1 Minor Subdivision were Tim Lyons, Morgan Ellsbury, Josh Jacobson and Harrison Stordahl. After discussion, Jeanne moved to approve the Order Approving Minor Subdivision and Minor Subdivision Plat. Fred seconded, all ayes, motion carried.

The meeting adjourned at 2:08 o’clock p.m. to meet in regular session on September 6 & 7, 2022 at 8:30 o’clock a.m., in the Commissioner’s Room at the Courthouse in Sundance, Wyoming.
